can u buy something online say it doesnt work and get you money back without even sending the item back it seems you can if u buy off amazon

i posted a wii remote out to buyer she mailed amazon saying it doesnt work and i told them that i wud replace it but instead they refunded her the money so shes got a remote that prob works and her money back

Amazon screwed up by the sounds of it. I take it that the sale was through Amazon Market Place. Under Distance Selling, you do not have to give a refund before the item is returned and in your posession. I would have thought that Amazon would have had to check to ensure you had the item back first. Not like its a £2 job and it would have cost more to return it than the refund was worth

I would kick hell up with Amazon. They are in the wrong, as is the buyer who never returned it. Might be worth approaching the buyer and suggesting they return the item. I know that I would really play my face with Amazon over it.
