Help needed..

Hi guys, somewhat off topic .. i wont bore you with all the details but had an accident couple years ago and the guy tried to claim off my insurance, wasnt happy with the offer so then issued a lawsuit from which my insurance hired a solicitor to work for me. Anyhow it was listed for court yesterday but i had a call day before to tell me no need to go the case had been settled. As of writing this 2 things have happened... 1. im still awaiting contact from my solicitor to tell me the outcome although his company assures me it is settled. 2. The claimaint called me last night saying i now owe him £11.000 .

My question is when a claim is settled does that claimaint not have to sign a release paper to say there will be no other claims in the future before he recieves any payment?

Any replies appreciated.

once the papers have been signed then no they cannot take further claims

Going from my own experences in a RTA, once release papers have been signed to something like..... I Paul Griffin, to herby accept offer of payment of £10,000 as complete settlement of my claim against john stevens case number 0898550055.... then it would be case closed, as if the claim had been settled in full, and thus no additional claims can be entered into relating to this case.

yes very much so its normal for them to let off abit of steam but trust me its a normal reaction, i know as i have been through it when i had lincs*******

as i have stated already once they signed then they have legally agreed in writing

Means nothing that he called you, if it was me I would have 100% definitely told him to f*** off. Why is he / his solicitor entitle to call you, that should be done between solicitors or insurance companies, not your good self....What a cheeky prick.

If it's not in writing it means nothing, that and the cased has already been settled.

yep thanks guys... got it confirmed today by my solicitor who is going to be in touch with his solicitor about the calls.

In addition to the above, if he keeps calling you then you can threaten to sue him under the 1997 Protection from Harassment Act

Of course, consult with your legal representative first and initiate no direct contact with him yourself...

Thanks for that link Magz... i have spoke to my solicitor and he is to make contact with the other party so hopefully that will be the end of it. If not then i will take it further .

i would speak to your insurers and solicitors as i think he is trying it on.

Jut noticed the claim number you referred to in your example Stan....0898550055? Was that an old porn line you used to call!? ;)
