Just wondering if any one on here could offer me a bit of advice,Whilst driving to work today i was unfortunate to be hit by another driver.I have a few questions to ask and would be grateful of any replys.
1 Does it take long to sort out?
2 Will his car insurance pay all of my finance off?
3 The girl who was taken to hospital, will she claim off his insurance?
Forgot to mention that the guy did accept all resposibility and luckily for me police took statements off both of us,And also when i bought the car i didnt take out gap insurance.

Hope everyone was ok in the end....
To be honest CS I don't think this could be answered as i'd presume there are so many outcomes depending on circumstance.
I'd suggest calling your own insurance, they usually offer free legal advice.

do you have his insurance details, registration number etc? IF so then get in contact with his insurance company and let them know what happened, explaining that he accepted liability.

should never go to the insurance if you can help it
look at it like this
the cost to repair damage cause by the crash = a fixed amount
the insurance will probably make you pay the 1st £600 then you'll have lost no claims bonus & you'd of had an accident so they'll bump the cost of it up for so many years
either way youll be out of pocket & 99/100 its cheaper not to get insurance involved, even if you phone them to see how much a claim is they'll still jack ya premium up even though you may not get any money off them

Looking at my car after m8 it will be a write off and ive only had it 4 months so i have to go through his insurance.
Surely it won't affect my no claims if he admits its his fault

is it a write off or a total loss?
i know one way theyll pay you half of the cars value
not sure what the other one is ;S
and to the insurance the other driver admiting it was their fault well, it dont mean anything, i dont see the point in insurance as it never works to our favour

Matt, it appears you had a bad time....
Insurance companies will of course try to save their own pennies...if they can screw One of their peers then they will, I stick with what I say originally...

it wasn't me
it was a family friend
been driving 35 years, always been with the same company, never ever claimed, refered people to them
if they're harsh to him then what will they be like to CS?
who is your insurance provider out of curiosity?

Think it depends on the insurance companys really. From what i gather they are a lot better now than they used to be but as was stated earlier even a written statement of liability means nothing these days. The company that is being claimed against will naturaly use fair means or foul to at least apportion some of the responsibility elsewhere. In mittigation for insurance companies i can however tell my story from last year. An elderly lady tried to reverse down a narrow side street where i was parked. She scraped one side of my car in a couple of minor areas. She instantly got out and gave me her details. She was covered by a ladies only diamond insurance. They gave me my own direct local number to call my claim manager and let me have my car fixed at the garage of my choice!! All settled in about six days and had my bumper scuff sorted in the process!

Hi
I will answer your questions above in order
1. Depends on the insurance company when some divvy bird when up me ass end at roundabout our claims for whiplash were sorted in less than a month. T.B.H. we would not have botherd with a claim but she was so stroppy and was not at all concerned about us just wanted to get to work, It was a struggle to even get her basic information out of her, it was not until i threatened to call the police that she provided this.
2. Not a hope in hell this is why there is GAP insurance and why you should allways take it out you will get from the insurance company an offer of about half the actual value of the car, you will then have to find the differance to pay off your loan. I never take out the payment protection insurance on a car loan but I allways take out the gap insurance just incase, this means i can get the car paid off ASAP and then get a new one double quick. And its only £3 pm more on the loan..
3. If the girl was a passinger in your car you will have to make a claim on her behalf via your insurance (this is what I did in my case above) and your insurance will then pursue a case against the driver and his insurance company, you should also make a claim for any injuries, if you do this thay may also be able to get your volantary excess payment back as well.
If the Girl was a pedestrian or in his car then she will need to make her own claim against the driver by going to one of the many no win no fee outfits that are around. As he has admitted liability then any resulting claims for damageds should all go to his insurance company.

You will end up out of pocket i'm afraid, should've taken out the gap insurance.
If it's a write off then you'll get a fixed figure from Glass's Guide, a book that all insurance companies use to price a write off.
You can attempt (in vain) to claim back your excess from their insurer - if you don't ask you won't get.
Insurance is supposed to be about indemnifying the purchaser of the Insurance i.e. making sure that they are in exactly the same position before said accident or whatever - just doesn't seem to pan out that way.
