I put my machine on ebay, it got removed because i forgot to say that the payout had been disconnected. Which is fair enough so i put at the bottom of the ad in capitol letters stating the payout had been disconnected. So its been removed again for the same reason as first time? Am I missing somthing here, anyone had this before?

You listed a slot machine. Please note that the sale of slot machine are only permitted if a current licence or permit has been issued to you by the Gambling Commission. The current licence or permit must clearly state that you are licensed by the Gambling Commission and prominently display the licence or permit number at the top of the individual listing. Furthermore, removing or disconnecting a component(s) of a functional gaming machine in order to sell it on eBay does not render the machine non-functional for the purpose of this exemption.

Thats what I get in the email, so how are all these other people getting away with it?

Sorry to say it Cardie but you need to buy a permit to sell your machine by law.

Dont take that as a moan at you - but ebay are getting the heat from the gaming board and hmrc for letting these sales happen.

I know there are loads of others listed and there does not seem to be a fair way about this yet as ebay seem to want the money with sold machines but trust me they struggle to understand the law as they even removed mine before.

It took 3 calls to ebay and over 2 hours talking to ppl who did not even understand the selling rules.

But you can get a permit from the local council for about £25 i think.

Again please do think this is a moan at you - its not - i just think ebay are struggling to keep up with the laws.

Best wishes
Stu.

Have a look at some of the completed ads from private sellers.

It seems if you put all the bollox that they need you to, then they let the ad run, coin handling removed, home use only, not for financial gain, winner needs to sign to say they will only use it for home use plus whatever else you can find.

It would seem that some people are lucky and their ad runs and others not.

To be honest ebay have no consistency in which ads are removed and which not.

Oh and another thing seems to be .... state all this in BIG lettering and keep putting 'EBAY PLEASE DO NOT REMOVE AS THIS AD NOW COMPLIES WITH UK AND YOUR RULES.

It's worth a try m8

Good luck with it.

Its not worth risking the ebay account as this will be the third time? It states quite clearly that if I havent got a licence then I cant sell it :( How am I supposed to sell it now?

Stick it on gumtree, or preloved, and local adtrader, doesn't cost you and you won't have any paypal fees to pay.

Gumtree's a pain in the arse as well.

I got an ad 'processing' it's been like that for 24 hours.

I thought I'd contact them and ask why and this is how far I've got ....

Your Question:
----------------------
Why is my ad still processing after 22 hours pls?

Their reply

Hello Phil,

I am sorry that it was not clear why your adverts are not showing.

I have had a look into this for you and have found that that your ads have been removed and your access restricted as we have found that you have continually broken our posting rules.

To avoid you continuing to break our rules we have taken precautions to prevent your adverts from being posted onto the site.

We reserve the right to remove ads in accordance with our terms and conditions as seen on the website (http://www.gumtree.com/disclaimer.html).

We are really sorry for any inconvenience caused. Thanks for oyur patience and understanding.

Thanks,
Leanne

My Reply

Hi Leanne

Could you please tell me what rules I have continually broken?

I haven't listed ANYTHING for months and have NEVER been informed that
anything I have advertised has broken ANY rules.

The ONLY thing I can think of is that I once advertised the same item on
consecutive days, but I can't see that it could be that, as other people do
it all the time. Infact there are loads of adverts on there now for the
same thing from the same seller, who keep relisting day after day and their
ads are never removed.

I REALLY need you to clarify what I'm supposed to have done wrong and what
rules have been broken, and by which ads, as I'm starting to get the feeling
that someone else might have used my account if anything apart from the ad I
tried to list yesterday has been advertised in the last few months.

Many Thanks

I've not got a clue what's going on, this is the 1st thing for months I've tried to sell on there, but yet she says they've had to remove my ads.

I've not had ANY of the emails they send with the ad ref no on, so if anythings been listed it sure as hell isn't by me!

Still waiting for a response to my reply, will let you know what happens, oh and the ad I'm trying to list is for the exercise machine so I can't see what rules that breaches.

I think Ebay log accounts that sell machines often and then vet them more than the new random account.

I have a few customers that buy from me then after a few months sell on and they have been saying there ads get rejected or removed more now.

I have see like said above the comments about hoppers/ coin mechs removed, free play only - what annoys me is if they really feel they have to enforce this law then stop everyone not just the odd few.

Common sence would be not allowing any fruit machine sales via ebay unless your licence was checked but thats to much hard work for ebay, lol.

Bottom line is HMRC want the money and remember selling an AWP without a licence can be a £10000 fine - Hoping that scares you enough to buy a temp permit for re-sale.

Just think £10000 per machine fine for ebay - ouch.

You will also find that other people might be reporting you mate,

I sell xbox's on ebay and people are always reporting me saying im selling them with modded firmware, but as i was told by an ebay staff if i dont put on there that the console wont be modded in any way i can have my listing removed at anytime if reported....

I dont think ebay know their own rules and regulations sometimes.

I find the following statement on e-bay to be the best way to sell.

To comply with the UK's Gaming Act and e-bay's rules concerning the sale of Gambling Equipment, this machine operates in free play mode only, and thus unable in it's current state to operate "For Profit" or "Financial Gain", and is therefore compliant with the UK's Gaming Act and current E-bay rules.

Please contact myself for more information concerning this if you have any questions.

Obviously, you do mention in your auction that everything has been tested and working, before you set free play up.

Now, to force free Play mode, it could be something simple as a back door switch moved (Cash door does not work on some machines for test mode), so the machine thinks it's in test mode, even with the door shut, and the way I do this, is just move one screw, something anyone can fix to run in full mode if they so wish :)

All you do, is tell the buyer where this switch is and why it's been done, so all they need to do, is move just one screw back if they so wish to ;)

I've done this on all machines I have sold the past year, and to date, no problems yet :)

.....and removed :(

Warn them, that the machine is compliant with the UK's gaming Act, is that it can NOT be used for financial gain, and as such, declassifies said machine as a gambling device, as no financial gain can be got from it.

Have you got access to another account (mates or another family member) you can sell it from? They are probably watching your account like a hawk now and no matter what you put they will pull the add mainly due to what you put if the very first add. Although you say you are complying with the law they will assume that your just putting that to try and get round the law/their sell rules. Ebay can be a class A tw*t at times.
